Many of our clients tell us, ‘we are ok, we pay over the Award’. However, did you know that you cannot actually contract out of an Award unless you provide a guarantee of annual earnings under the Fair Work Act? So when is the last time you ran a calculation to check your staff are still paid ‘above’ the Award? Now could be a good time. The second most common misconception employers have is that they have nobody covered by a Modern Award at their workplace. The simple fact is, if you have a receptionist, accounts staff, administration and PA’s etc they are all covered by the Clerks Award, which contains lots of unique provisions that employers can unknowingly not comply with.
The big news is the Fair Work Commission increased the national minimum wage to $640.90 per week, which is a 3% increase applied to all Modern Award minimum rates effective from the first pay period on or after 1 July 2014. Coupled with the increase to the superannuation guarantee to 9.5%, this is going to be an expensive year for employers.
