Have you been involved in an unfair dismissal (yet?). Here are some very interesting facts:
  • Applications have increased by 4% in 2012-2013
  • 81% of applications settle at conciliation
  • 5% are resolved at hearing
  • Employers with more than 100 employees receive 43.6 % of claims
  • Surprisingly small employers with less than 14 employees received 20% of applications
  • Close to 1% result in the employee being reinstated into their former role
  • About 60% of applications were resolved by way of a monetary settlement

Maybe worst of all, 3 months was the average time to finalise an unfair dismissal claim. Often, if an employer simply follows the right disciplinary and termination process, unfair dismissal claims can be avoided or at the very least successfully defended so all parties can move on.
